1. Terms and Conditions:
All persons (“Participants”) entering the MEDAL Start It. Paint It. Show It. Competition (“Promotion”) agree that the Promotion rules, as set out in these Terms and Conditions (“Terms and Conditions”), shall apply and are binding on them.
- The Campaign commences on the date these Terms and Conditions are published on the Medal Paints website and runs until closed by Medal Paints at its sole discretion. Medal Paints will provide notice of the closing date on its website and social media channels.
- The Promotion runs in weekly cycles. Each weekly cycle commences on a Monday at 00:01 and closes the following Sunday at 23:59 (the “Weekly Entry Period”).
- Five (5) winners will be drawn at random at the end of each Weekly Entry Period.
- Weekly winners will be announced on Medal Paints’ Facebook, Instagram and TikTok pages within five (5) business days of the close of each Weekly Entry Period.
- Each weekly winner will receive one (1) Medal Paints product suitable for the DIY project described in their entry, as determined by Medal Paints in its sole discretion.
2. How to Enter
- Follow Medal Paints on at least one of the following platforms: Facebook (@MedalPaintsSA), Instagram (@medalpaint), or TikTok (@medalpaints).
- Post a public photo or video of the DIY project you want to paint, using the campaign hashtag #STARTITSHOWITPAINTIT and tagging Medal Paints.
- In the post, tell Medal Paints what you need to finish the project.
- Tag two (2) friends in the post.
3. Qualifying Criteria
- Participant is a permanent resident and/or citizen of the Republic of South Africa.
- Participant has a valid identity number.
- Participant is 18 years and older.
- Participants’ social media accounts must be set to public so that Medal Paints can verify the entry. Private or restricted accounts will not be eligible.
- Participants may enter multiple times during the Promotion period, but each entry must relate to a different DIY project. Duplicate entries for the same project will be disqualified.
- Each Participant may only win once per Weekly Entry Period.
4. Selection of Winners
- Five (5) winners will be selected by random draw from all valid entries received during each Weekly Entry Period
Medal Paints reserves the sole and absolute right to disqualify any entry that does not meet the qualifying criteria, is deemed inappropriate, offensive, unsafe, fraudulent, or in breach of these Terms and Conditions or any platform community guidelines. The decision of Medal Paints is final and binding, and no correspondence will be entered into in this regard.
- Medal Paints reserves the right not to award all five (5) weekly prizes in any given Weekly Entry Period if, in its sole discretion, fewer than five (5) valid entries have been received.
- Winners will be notified via direct message on the social media platform on which they entered. Winners must respond and confirm acceptance of the prize within seven (7) days of notification, failing which Medal Paints reserves the right to forfeit the prize and select an alternative winner by random draw.
5 .General terms
- Each weekly winner will receive one (1) Medal Paints product suitable for completing the DIY project described in their entry.
- The specific product, range, finish, colour and quantity awarded to each winner will be determined by Medal Paints in its sole discretion, based on the project submitted.
- Prizes are limited to one (1) product per winner per Weekly Entry Period.
- Prizes are non-transferable and have no trade or cash value.
- Prizes are non-refundable, non-exchangeable, and cannot be redeemed for cash or any other product. Medal Paints reserves the right to substitute any prize with another product of similar value at its sole discretion.
- Prizes will be delivered to a South African physical address provided by the winner, or made available for collection at a designated Medal Paints retailer, at Medal Paints’ discretion.
6. Content and Intellectual Property Rights
By entering this Promotion, Participants grant Medal Paints a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, publish, distribute, adapt and display any content (including images, videos, captions and likeness) submitted as part of their entry, for the purposes of:
- Promoting this Promotion and Medal Paints’ products and services.
- Reposting on Medal Paints’ owned social media channels (Facebook, Instagram, TikTok, LinkedIn) and website.
- Use in Medal Paints marketing materials, including but not limited to digital advertising, in-store displays, brochures, and trade communications.
- Participants warrant that they own or have the necessary rights to all content submitted, and that the content does not infringe the intellectual property rights, privacy, or any other rights of any third party.
- Participants warrant that any persons featured in the submitted content (including the Participant) have given consent to be featured and to have the content used by Medal Paints as set out in these Terms and Conditions.
- Where minors appear in any submitted content, the Participant warrants that they are the parent or legal guardian of the minor, or have obtained explicit consent from the parent or legal guardian, and that the content is age-appropriate.
- Medal Paints will, where reasonably practicable, credit the Participant when reposting their content, but is not obliged to do so.
- Participants indemnify Medal Paints against any claims arising from a breach of these content warranties.
7. Restrictions
- The Promotion is not sponsored, endorsed, administered by, or associated with Facebook, Instagram, TikTok, or any other social media platform.
- Participants release Facebook, Instagram, TikTok and any associated platforms from any liability arising from the Promotion.
- Entries that are deemed offensive, defamatory, unsafe, in breach of any law, or contrary to public morals will be disqualified.
- Entries promoting or featuring competing paint or coatings brands will be disqualified.
8. General Terms
- Without detracting in any way from the Promotion Terms and Conditions, the following general provisions shall be applicable to these Rules.
- The Promoter/s of this Promotion are the Organisers. The Organisers will interpret the Terms and Conditions in their sole discretion and reserve the right to amend the Terms and Conditions at any time in accordance with the provisions contained in these Rules.
- By entering and participating in the Promotion, you agree that the Organisers may collect and process your personal information for purposes of this Promotion, in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and Medal Paints’ Privacy Policy.
- The Organisers, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with this Promotion and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter this Promotion.
- In the event of a dispute, the decision of the organisers will be final and binding and no correspondence will be entered into in this regard, and for further clarity, the organisers shall be entitled to deal with such disputes (or any failure by entrants to follow the rules) in their sole discretion, including that the organisers shall be entitled, in addition to any other rights which the organisers may have in terms of these rules, to immediately disqualify entrants from this Promotion.
- By entering the Promotion and/or accepting any prize, the entrants, users and/or winners hereby indemnify, release and hold harmless the organisers (including their subsidiaries, holding companies and affiliates), their directors, employees, agents, suppliers and contractors (the “organiser parties”) from and against any actions, claims and/or liability for injury, loss, damage, expense, claim or damages of any kind resulting in whole or in part, directly or indirectly, from participation in the Promotion, and/or the use, acceptance or possession of a prize, and/or participation (or non-participation) in a prize-related activity.
- Entrants who, in the Organisers’ sole determination, act unlawfully, fraudulently, in breach of these Rules and/or Terms and Conditions or otherwise dishonestly may be disqualified from participating in the Promotion and shall not be eligible to win any prize.
- Additional to any other rights contained in the competition rules, the organisers reserve the right to terminate the Promotion at any time with immediate effect. If this is the case, the organisers will provide a notice on the website and it shall be the responsibility of entrants to review such website in this respect. In such event, all entrants hereby waive any rights which they may have against any of the organiser parties and acknowledge that they will have no recourse or claim of any nature against the organiser parties.
- The Promoters are not liable for any technical failure that may result in an entry not being successfully submitted. Any prize is accepted by a winner at his/her own risk and the organisers are not liable, at any time, for any defect in the prize.
- The duration of this Promotion may also be extended or curtailed at the sole discretion of the Promoters. If this is the case, the Organisers will provide notice of this on the Website.
- MEDAL Paints reserves the right to block entries and Participants if found abusing the competition rules and mechanics.
